TERMS AND CONDITIONS OF SALE
This Agreement is concluded between:
1. The Seller: Maryse Tiroul, operating as a Sole Trader and trading under the business name Marushka Tziroulnikova, with business premises located at 19A Pier Street, Ventnor, Isle of Wight PO38 1ST, United Kingdom. The Seller is registered with the Information Commissioner’s Office (ICO) under registration number C1660189. (hereinafter referred to as "the Seller").
2. The Buyer: Any natural person or legal entity wishing to purchase products or services by completing an online form or proceeding to a direct payment on the Seller's website (hereinafter referred to as "the Buyer").
Preamble and Licensing Rights:
The Seller publishes and distributes the range of products and services featured on the official websites: www.leverbeguerisseur.com and www.marushkastories.com.
Article 1 – Introduction and Scope
1.1 Agreement to Terms: By placing an order, the Buyer acknowledges having read and agreed to be bound by these Terms.
1.2 Precedence: These Terms prevail over any other conditions not expressly approved in writing by the Seller.
1.3 Amendments: The Seller reserves the right to amend these Terms at any time. The Terms applicable are those in force on the date of the order.
Article 2 – Description of Goods and Digital Content
2.1 Scope: The Seller provides Digital Content (programmes), Bespoke Services (online consultations), and Physical Goods.
2.2 Availability: Physical goods are subject to availability. The Seller reserves the right to modify or discontinue any product at any time.
Article 3 – Pricing and Payment Terms
3.1 Price Indication: Prices are inclusive of all applicable taxes and are displayed in British Sterling (GBP).
3.2 Changes: The price applicable is the one shown at the time of order submission or payment validation.
3.3 Delivery Charges: For physical products, transport costs are itemized at checkout.
Article 4 – Ordering Process and Contract Formation
4.1 Methods: Orders are placed via a request form or direct purchase buttons.
4.2 Contract Formation: The contract is formed only when payment is successfully validated.
4.3 Documentation: Upon payment, the Seller will issue an invoice and delivery instructions (digital) or shipping confirmation (physical).
Article 5 – Provision of Services (Digital Programs & Consultations)
5.1 Human Expertise: All data analysis and consultations are performed by humans, not machines.
5.2 Service Hours: Services are conducted Monday to Friday, 9:00 AM to 6:00 PM (GMT/BST), excluding UK public holidays.
Article 6 – Refund & Cancellation Policy (Digital & Bespoke Content)
6.1 Bespoke Nature: In accordance with the Consumer Contracts Regulations 2013, the 14-day right of withdrawal does not apply to bespoke or personalised digital content. Once production begins, sales are final.
6.2 Waivers: By accessing the digital content immediately, the Buyer waives their right to cancel.
Article 7 – Refund & Returns Policy (Physical Goods)
7.1 Statutory Right: For physical goods, the Buyer has 14 days from receipt to withdraw.
7.2 Condition: Items must be returned in their original, resaleable condition at the Buyer's expense.
7.3 Reimbursement: Refunded within 14 days of receipt of the returned goods.
Article 8 – Retention of Title and Intellectual Property
8.1 Licensing: Digital products are licensed, not sold. Ownership remains with the Seller.
8.2 Retention of Title: Physical goods remain the Seller’s property until full payment is received.

9.1 Transfer of Risk: For physical goods, risk passes to the Buyer upon physical possession.
9.2 Delivery: Digital links are sent within 48 working hours. Physical delivery is subject to carrier timelines.
Article 10 – Complaints, Liability and Warranties
10.1 Disclaimer: Advice provided during consultations is for educational purposes. The Buyer is solely responsible for its application.
10.2 Faulty Goods: Statutory rights under the Consumer Rights Act 2015 apply for faulty items.
Article 11 – Data Protection and Privacy
11.1 UK GDPR: Data is processed in compliance with the UK GDPR and Data Protection Act 2018.
11.2 Rights: The Buyer has the right to access, rectify, or delete their data by contacting the Seller.
Article 12 – Intellectual Property Rights
All website elements and algorithms are protected under the Copyright, Designs and Patents Act 1988. Any unauthorised reproduction or linking is strictly prohibited.
Article 13 – Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
